Am I Entitled to a Rental Car?

It depends on whose insurance is paying and what your own policy says. Here is the short version.

If you’re claiming against someone else

If another driver was at fault and you’re claiming on their liability coverage, you are entitled to a rental while your vehicle is being repaired. Some insurers will ask you to pay the bill and submit it for reimbursement rather than billing them directly. That is worth checking at the start rather than at the end.

If you’re claiming on your own collision coverage

You’re entitled to a rental only if you carry rental coverage on your policy. If you do, there are usually limits: a maximum number of days and a maximum per day. Those limits are why a slow repair can quietly become your problem. If you’re not sure what you carry, your agent can tell you in a minute. If you have collision coverage but no rental coverage, the rental is yours to pay for.

What actually affects the days

The clock runs on the repair, not the estimate. Delays usually come from one of three places: waiting for the insurer’s appraiser, waiting for parts, or waiting for a supplement to be approved after more damage is found. We tell you which of those we’re waiting on rather than leaving you to guess.

One thing worth knowing either way: New York does not let your insurer make you use a particular rental company. If your policy has rental coverage, the insurer has to tell you that the choice is yours, and it has to say so again when you claim. If someone pushes you toward one company, you can say no.
